NGOs warn constitutional amendment threatens rule of law

Civil society groups warn that a proposed constitutional amendment by Prime Minister Robert Fico’s government, framed as protecting "national identity," poses a serious threat to human rights and the rule of law.

According to Via Iuris, the amendment could allow Slovakia to disregard EU law and international conventions, impacting vulnerable groups most. NGOs urge MPs across the political spectrum to reject the change.

They argue the proposal could undermine protections for education, culture, and family rights, enable censorship, and restrict the rights of women, children, and people with disabilities. Though promoted as defining gender, the amendment targets LGBTI+ people and risks increasing legal uncertainty and expanding state control over private life.

The organisations stress that Slovakia accepted the primacy of EU law voluntarily, not because the country is under a 'dictate from Brussels', but because Slovakia freely and voluntarily agreed to it with the other member states. By joining the EU, it agreed to shared rules while respecting national identity. They warn the amendment could lead to future sanctions.
