Slovak President Zuzana Čaputová did not rule out she might file a disciplinary motion against Prosecutor-General Maroš Žilinka in the future over his repeated use of the Paragraph 363 of the Penal Code. The given section allows the prosecutor-general to overturn the final decision of a prosecutor or police officer if the law has been violated by the decision or in the proceedings that preceded it. The Constitutional Court ruled that the Paragraph 363 is not at odds with the Constitution per se. The court, however, was not making a judgement on the way the Paragraph had been used by the Prosecutor-General.
According to the President, the recent written justification of the Constitutional Court's decision regarding the paragraph also contains sentences that might serve as a legal basis for such a disciplinary motion. "Once again, I will be at a crossroads as to whether or not to file a disciplinary motion. I wanted to wait for a decision from the Constitutional Court first, though," stated the head of state, who still needs to peruse the justification of the court's decision thoroughly.
