Government greenlights bill regarding unmarried couples

The interim Government at its session on Friday approved a Justice Ministry-sponsored bill that would make it easier for unmarried couples, including those of the same sex, to deal with various life situations. The bill introduces a so-called fiduciary declaration granting power of attorney, which "constitutes a simple legal act in front of a notary by which a person expresses in a notarial deed his or her will that someone else can act on his or her behalf as a fiduciary in specified life situations".
       

In the event of death, it would be possible for the appointed confidant to be declared administrator of inherited property as well as guardian of the children of the deceased individual. The declaration would also cover situations relating to personal care and representation in court and other proceedings. 
       

Interim Justice Minister Viliam Karas stressed that the role of the state is not to interfere in people's privacy, but to respect their autonomy in setting up their relationships with each other. "In this manner, we are helping unmarried couples and same-sex couples indiscriminately," he noted.
       

The legislation is proposed to enter into force on January 1, 2024.
