Slovak President Zuzana Čaputová is holding talks with experts regarding whether she should challenge the constitutionality of Section 363 of the Penal Code at the Constitutional Court. It gives the Prosecutor-General's Office the power to annul a decision made by a prosecutor or the police if the decision or the proceedings that preceded it were at odds with the law. In her opinion, Parliament should regulate the application of Section 363 by the PG's Office, for instance, in cases in which courts have already made some decisions. "The PG in Slovakia has strong powers," she said, adding that she expected the Government to limit these powers to some extent.
Čaputová made these comments in regards to the fact that the PG's Office used Section 363 of the Penal Code on November 29 to scrap the charges that were pressed against Smer-SD head and former PM Robert Fico, ex-interior minister Robert Kaliňák, former Police Corps President Tibor Gašpar and his family member, and controversial entrepreneur Norbert Bödör. All of them were charged in the Twilight case, which concerned extensive corruption. The PG's office claimed that it did so due to violations of the law during the investigation.
