Achmea dispute settled in Luxembourg

On Tuesday, the European Court of Justice published an opinion which stated that dispute settlement provisions contained in international treaties on investment protection, to which EU member states are parties, have been deemed invalid due to their inconsistency with EU law. As explained by legal firm Taylor Wessing - Andrej Leontiev, the decision means that the German Supreme Court will probably have to cancel its original arbitration decision, which ordered Slovakia to pay approximately 22 million euro in damages to the Dutch insurer Achmea. The sought damages stem from a bilateral investment treaty inherited from the former Czechoslovakia.
